The Privacy Policy covers information that you submit to us electronically via our electronic media(s) when communicating with us, ordering and purchasing products on-line, downloading information, registering, responding to data and information requests, and other intended uses of such media(s). Please read these Terms and Conditions of Use, Privacy Policy and Refund Policy carefully before using the System. Your use of the System means that you accept and agree to these Terms and Conditions of Use, Privacy Policy and Refund Policy. If you do not agree to these Terms and Conditions of Use, Privacy Policy and Refund Policy do not use the Sites or access the System.

Privacy Policy
Collection of Personal, Pet and Other Information such as Financial, Location, etc.
When you use or register, apply, respond to questionnaires or other forms, request information and/or use the Sites, and/or System including AESOP for other purposes, we may ask for certain Personal Information. This information is voluntarily provided by you and may include, but is not limited to your name and contact information (email address, mailing address, phone number, personal preferences, personal identifiers, and financial information like accounts or credit card information when using our E-Commerce Site to order and purchase products, and other data and information associated with you as a user and/or buyer of Lystn’s products, services, and information). This information may also be collected to locate a retail store, distributor, business associate or otherwise participate in activities or services or access information generated on our Sites, and/or System including AESOP. All Retail Store locations are independently owned and operated, and Lystn Corporation does not own or operate these locations.
Based on the information you provide us, we may also collect information from consumer reporting agencies, such as credit bureaus, in order to evaluate your ability to meet your obligations when using and/or participating in our Sites and System.
Contact information is used to communicate with users. Financial information collected is used to bill the user for products and services. Comments, questions or complaints submitted to us about a Lystn product or retail store, distributor and/or business associate involved will be forwarded to the appropriate personnel, including a retail store, distributor and/or business associate if applicable, along with any contact information you provide with your comment. If you have comments regarding a specific location, we recommend you contact that location directly so that they may personally and immediately assist you.
Depending on the nature of your activities on the Sites, and/or System including AESOP such as use of our Feeding Calculator, we may also ask for information regarding your pet such as weight, age, breed, feeding habits, calories and nutrition, behavior, personality traits, preferences, health history, and more. Additionally, we may ask for any login ID and password created by you.
Our Sites, and/or System including AESOP utilizes cookies to track your online activities (pages that you look at and information downloaded to your computer), including, but not limited to, registration, submissions, products, shopping cart and information requests. (Cookies are small data text files written to a user’s hard drive (sent to and stored on your computer’s hard drive) to allow the web site to recognize you through your IP address as a web site user, if you return to the web site using the same computer and browser [inform a web site if the user has previously viSited that Site], or for other reasons.) This information is collected for web metrics, traffic analysis, and System administration. Depending on the browser that you use, you can set your preferences to block/refuse cookies, and/or notify you before they are placed, in other words cookies can be rejected by you and if so, none of the functions listed above will be performed.
Cookies are not harmful and cannot introduce viruses or extract personal contact information (the cookie never contains data that is “executed” as code, so it cannot carry viruses).Cookies are linked to browser programs and do not specifically identify an individual user. While perhaps used by business associates of Lystn but not currently directly used by Lystn itself (but perhaps in the future), third-party vendors may use cookies or other trend research tools (such as Google Analytics) to advertise (behavioral advertisement) to our users online and first-party cookies (such as the Google Analytic cookie) and third-party cookies (such as DoubleClick cookie) together to inform, optimize, and serv advertisements based on your past visits to the web site or another Site affiliated with Company products or services. These third-party vendors may display company product or service advertisements on other web sites based on your internet usage. Any information that these third parties collect via cookies is not linked to any personally identifiable information (name, address, email address, or phone number) we collect, or you provide on the System. You can opt-out of Google Analytics for Display Advertising by using Google’s Ads Settings.
Electronic Communications
Visiting Lystn’s Sites and using the System or sending emails to us constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on Sites (including web sites), satisfy any legal requirement that such communications be in writing. Any communications, material or information you transmit to Lystn’s Sites and the System by electronic mail or otherwise, including data, questions, comments, or suggestions, will be treated as nonconfidential and nonproprietary and will become the property of Lystn or its affiliates. Such communications, material and information shall be used for any purpose including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, and posting. Furthermore, Lystn is free to use any ideas, concepts, know-how, or techniques contained in any communication, materials or information you send to Lystn’s Sites and the System for any purpose whatsoever including, but not limited to, developing and marketing products using such communication, materials or information.
Linking to Other Web sites
Lystn’s Sites and System may be managed by or contain links to other Sites (including web sites) operated by third parties. Lystn does not control such Sites and will not be responsible for their content or for any breach of contract or any intentional or negligent action on the part of such third parties, which results in any loss, damage, delay or injury to you or others. Inclusion of any linked web site does not imply or constitute any review of, approval or endorsement of the linked web site by Lystn. If you decide to leave the System to access these third-party sites, you do so at your own risk. These third-party sites may have privacy policies provisions that differ from the provisions of Lystn’s Privacy Policy. Lystn’s Sites and the System may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on other web sites or social media platforms is governed by the terms of use and privacy policy of the particular web site or platform. To ensure your privacy is protected, we recommend that you review the privacy policies of other web sites or platforms you visit. By using our email Site, you consent and agree to the terms and conditions governing our email Site. Information Collected By and From Social Media Services and Other Third-Party Platforms
You may also can engage with our content through any number of social media services, other third-party platforms or other third-party social media applications, plug-ins, or integrations. When you engage with our content on or through social media services or other third-party platforms, applications, plug-ins, or integrations, you may allow us to have access to certain personal and other information in your profile. This may include your name, e-mail address, photo, gender, birthday, marital or couple status, location, an ID associated with the applicable third party platform or social media account user files, like photos, videos, biometrics, your list of friends or connections, people you follow and/or who follow you, or your posts or "likes", “dislikes”, etc. For a description on how social media services and other third-party platforms, applications, plug-ins, or integrations collect, disclose, use and otherwise handle your information, please refer to their respective privacy policies and terms and conditions of use, which may permit you to modify your privacy settings or opt out of certain features.
As Exhibits to this document, Lystn has included the content and Web site addresses for the Privacy Policy of nopCommerce, Elavon and UPS. NopCommerce is the software used to run the shopping cart and other aspects of Lystn’s E-Commerce Site. Elavon is the credit card processing third-party. UPS is the shipping company for products of AESOP. Please read fully their Privacy Policies. Please visit these sites for updated and other requirements and policies such as Conditions of Use. By accepting and agreeing to Lystn’s Terms and Conditions of Use and Privacy Policy you acknowledge you have read and are aware of and agreeing to the nopCommerce, Elavon and UPS Terms and Conditions of Use, Privacy Policies, and any other requirements as amended in order to participate in Lystn’s Sites, and/or System including AESOP. Mobile: When you download or use applications (apps) created or offered by ANSWERS™ Pet Food or an affiliated company, we may receive information about your location and your mobile device, including a unique identifier for your device. We may use this information to provide you with location-based services, such as advertising, search results, and other personalized content. Most mobile devices allow you to turn off location services.
Information from Other Sources: We might receive information about you from other sources and add it to our account information.
Use of Personal and Pet Information
We use cookies and the information collected on our Sites and System to better understand our customers’ interests, their pets, and ways to improve our products, processes, E-Commerce Site, Web Site and content. We use your Personal and Pet information and other data collected throughout the Sites to provide you with information regarding recommended feeding to your pets, recommended calories, diets, nutrition and to otherwise provide you with requested information or services. Information provided by Lystn is based on our science and nutrition research, experiences, recommendations and suggestions as a manufacturer and formulator of products of Lystn and in no way, is intended to replace, supplement, take precedence over, contradict or negate related recommendations by licensed pet health professionals such as veterinarians. We may also use your Personal Information to send you automated email messages or marketing materials regarding our products and services. You may opt out of receiving such marketing email messages or request that we correct or delete any personal information that you have provided to us by sending a message to info@answerspetfood.com. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
While we have taken reasonable security measures to protect the loss, misuse and alteration of the information under our control, please remember that no computer system should be considered safe from intrusion. Email may pass through many computer systems and should not be considered as a secure means of communication. Even when encrypted, the information is only as secure as the encryption method.
Lystn, LLC only uses information collected to fulfill your on-line order requests as described herein, to provide requested services, and to keep or customers informed of products, promotions, and other information regarding Answers Pet Food and treats. We do release account and personal information when we believe release is appropriate to comply with law; enforce or apply our Terms and Conditions of Use such as this Privacy Policy and other agreements; or protect the rights, property, or safety of our Sites’ users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. This does not include selling, renting, sharing, trading or otherwise disclosing personally identifiable information from customers for third party marketing purposes in violation of the commitments set forth in this Privacy Policy.
Disclosures of Personal Information
Lystn will not sell or rent your personal information to anyone and Lystn does not share personally identifiable information with any nonaffiliated third parties other than for the primary purpose for which the information was collected, except with your express permission, or in the limited circumstances described below:
- We need to share the information to provide the product, service or information you requested.
- We may disclose information to companies and individuals we employ and/or work with on behalf of the company to perform business functions, manufacturer and deliver product, and provide services and information to you or on your behalf. Such functions may include, for example, hosting our Web servers and administering our Web Site, analyzing data, providing legal, accounting and marketing services, logistics, transportation, fulfillment centers, distributors, retail stores, packaging, cold storage facilities, etc.
- Lystn may disclose Personal Information in special cases where Lystn has reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our Terms and Conditions of Use or may be causing injury or interference with our rights, property, our customers or anyone who could be harmed by such activities. We may also disclose Personal Information when we believe, in good faith, that the law requires it such as responding to subpoenas court orders or legal process and for administrative and other purposes necessary to maintain services and improve our products and services.
- Lystn currently verifies credit card information given by you through a 3rd party clearing company, Elavon, but perhaps in the future potentially others may include other third parties such as "PayPal", "Worldpay" "Chargify" or other similar type processing centers may be used. The clearing company is solely a link in the distribution chain. See Elavon Privacy Policy as an Exhibit to this document.
- When user demographic information is shared on an aggregate basis in a manner that will not personally identify the individual who submitted the information.
- When we find that actions taken by you on the Sites, and/or System including AESOP that violate the Terms and Conditions of Use, Privacy Policy, Refund Policy or any of our usage guidelines and policies for specific products, services or information.
- You should also note that the servers hosting our Systems are located in a number of different countries including India and the United States. This means that the information you provide will be transferred to and hosted on servers in these countries and by using our Sites including submitting requested information you hereby expressly consent to such hosing and transfers of data and information.
How Users Can Limit Personal, Pet and Other Information Collected While we are committed to use and disclose our users’ personal, pet and other information only for the purposes identified, you can choose not to provide personal, pet or other information or limit the information obtained by us as follows:
- You can choose not to participate and use our Sites, and/or System including AESOP;
- You may limit the collection of “cookies” through your browser settings. However, this may disable our ability to provide you with the most relevant products, services or information regarding the Sites, and/or System including AESOP;
- You may have your contact information removed from our marketing lists to inform users of new or relevant products, services and special offers by emailing us at info@answerspetfood.com; and
- You may limit the ability of Google Analytics and other third-party cookies and trend research tools to track your online activity, as outlined. You can opt-out of Google Analytics for Display Advertising by using Google’s Ads Settings.
No Individual Under Age 18 for Data and/or Purchases Without Parent or Guardian
While we cannot control who views our Sites, System and AESOP, we do not knowingly market online to children under the age of 18 and we do not solicit data online from children under the age of 18. Answers Pet Food does not sell products for purchase by minors. We sell products for purchase by adults. If you are under 18, you may use shop.answerspetfood.comfor purchase of products only with the involvement of a parent or guardian. No one under 18 should provide any information on our Web Site or other Sites and/or System including AESOP without the involvement of a parent or guardian. We do not knowingly collect personal information from anyone under 18. If you are under 18, do not use or provide any information on the Web Site, register on theWeb Site, make any purchases through the Web Site, use any of the interactive or public comment features of the Web Site, or provide any information about yourself to us, including your name, address, telephone number, e-mail address. If we learn we have collected or received personal information from anyone under 18 without verification of parental consent, we will delete that information. Security
This Sites and System including AESOP has security measures in place to help protect against the loss, misuse and alteration of the information under our control. As an example, for the E-Commerce Site link, a password must be entered to log in to your account. While encryption methods are used to help protect sensitive and personal information, please note, however, that no data transmission over the Internet is completely secure. As a result, while we endeavor to protect your personal information, we cannot ensure or warrant the security of any information you provide to us and you transmit such information to us at your own risk. Once we receive your transmission, we endeavor to ensure the security of your personal information on our Systems. We transmit the entire credit card number to the appropriate credit card company during order processing. Our E-Commerce Site has been audited and certified PCI Compliant. Please note that Lystn will never ask for any personal information via email (e.g. marriage status, income, etc.). Be sure to sign off when finished using a shared computer.
